Eligibility & Use by Minors
DermaLens AI is intended primarily for users 18 years of age or older. Individuals below 18 years may use the App only through a parent or legal guardian who is 18+. In such cases:
- The parent or legal guardian must create and operate the account
- The parent or legal guardian must provide consent and supervision
- Any images, information, or data uploaded on behalf of a minor are deemed to be uploaded by the guardian
The parent or legal guardian assumes full responsibility for the accuracy of information uploaded and for decisions made using the App. DermaLens AI does not knowingly permit unsupervised use by minors.
Nature of the Service
DermaLens AI provides AI-assisted dermatology analysis, informational insights based on uploaded skin images, chat-based consultations with doctors, and educational health-related content.
The App is designed to assist and inform, not to replace professional medical care.
No Doctor–Patient Relationship
Use of the App does not establish a guaranteed or permanent doctor–patient relationship, does not involve physical examination, and may involve medical opinions based on limited digital information. Medical opinions may vary and should not be treated as definitive.
Medical Disclaimer
You acknowledge and agree that:
- AI outputs are provided for informational purposes only
- AI predictions may be inaccurate, incomplete, or delayed
- Chat-based consultations have inherent limitations
- Final medical decisions must be made by the user (or guardian, where applicable) in consultation with a qualified medical professional
DermaLens AI does not guarantee assessment accuracy, treatment outcomes, or medical results.
Medication Information Clause (Prescription & OTC)
5.1 Prescription-Only Drugs
- Displayed strictly for educational purposes
- Do not constitute prescriptions
- Must be used only under qualified medical supervision
5.2 Over-The-Counter (OTC) Drugs
The App may display information about medications commonly available as OTC drugs. You expressly agree that:
- OTC drug information is not medical advice
- OTC availability does not guarantee safety or suitability
- You are responsible for checking drug allergies, sensitivities, and contraindications before use
- You must read labels, warnings, and instructions carefully
- You should consult a medical professional if unsure
Any allergic reaction, adverse effect, misuse, or harm resulting from OTC drug use is solely your responsibility.
Limitation of Liability
To the maximum extent permitted by applicable law, DermaLens AI, its owner, developers, associated doctors, and service providers shall not be liable for:
- Any indirect, incidental, consequential, or special damages
- Any injury, loss, delay, misassessment, adverse outcome, or complication
- Any reliance placed on AI-generated outputs, informational content, or chat-based consultations
- Any misuse of prescription-only medication referenced in the App
- Any interruption, error, or failure of the App or third-party services
User Responsibilities
You agree to:
- Provide accurate and lawful information
- Upload only images and data you are authorized to share
- Use the App only for lawful, personal, and informational purposes
- Supervise and take responsibility for minor usage where applicable
You are responsible for all activity conducted through your account.
Prohibited Activities
You must not:
- Upload false, misleading, harmful, or illegal content
- Impersonate any individual or medical professional
- Abuse, harass, or threaten doctors or other users
- Attempt unauthorized access to systems or data
- Reverse-engineer, copy, or exploit any part of the App
Violation may result in immediate suspension or termination.
Account Suspension & Termination
DermaLens AI reserves the right, at its sole discretion, to suspend or terminate accounts, restrict access to features, or remove content or data. This may occur due to violation of these Terms, misuse or abuse of the App, or security, legal, or regulatory requirements.
No compensation is payable upon suspension or termination.
Data & Privacy
Collection and use of data are governed by the Privacy Policy. By using the App, you consent to data processing as described therein. You may request account or data deletion as per the Privacy Policy.
Intellectual Property
All software, AI models, content, design, and branding are owned by DermaLens AI. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App. You may not copy, modify, distribute, or commercially exploit any part of the App without permission.
Third-Party Services
The App relies on third-party services (including Firebase, Replit, and Neon). DermaLens AI is not responsible for downtime or failures of third-party services, or the data practices of third-party providers beyond disclosed use.
Modifications to the App or Terms
We may modify, suspend, or discontinue any part of the App at any time. These Terms may be updated periodically. Continued use of the App constitutes acceptance of the revised Terms.
Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. You agree that courts located in India shall have exclusive jurisdiction over any disputes arising from use of the App.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
